KidSpark ("we", "us", "our") is an educational gaming platform designed for children aged 4–10. Accounts are created and managed by parents or guardians. We are committed to protecting the privacy of children and their families.

2. Who Creates Accounts

KidSpark accounts are created exclusively by parents or guardians aged 18 or older. We do not knowingly allow children under 13 to create their own accounts or submit personal data without verifiable parental consent. If we discover that a child under 13 has created an account without parental consent, we will delete it promptly.

3. What Data We Collect

• Account information: Parent/guardian name, email address, and password (stored securely via Firebase Authentication).
• Game progress: Scores, stars, badges, streaks, game history, and CBSE curriculum chapter progress — used solely to personalise and improve the learning experience.
• Device & usage data: Browser type, device type, and anonymous usage analytics collected automatically by Firebase Analytics.
• Payment data: Processed entirely by our payment provider (Razorpay). We never store card numbers or banking details on our servers.

4. How We Use Your Data

• To save and display game progress, scores, and achievements.
• To operate the leaderboard (displays your chosen display name and score).
• To process subscription payments and manage your account.
• To improve the platform based on anonymous, aggregated usage patterns.

We do not use your data for behavioural advertising. We do not sell, rent, or share personal data with third parties for marketing purposes.

5. Third-Party Services

• Firebase (Google): Authentication, database, and analytics. Firebase Privacy Policy.
• Razorpay: Payment processing. Razorpay Privacy Policy.
• Google Fonts: Font loading. Requests are made to Google's servers. Google Privacy Policy.

6. Data Retention

We retain account data for as long as your account is active. You may delete your account at any time from the Profile page, which permanently removes all associated data from our systems.

7. Children's Privacy (COPPA)

KidSpark complies with the Children's Online Privacy Protection Act (COPPA). We do not collect personal information directly from children. All data is associated with the parent or guardian's account. Parents may review, update, or delete their account data at any time by visiting the Profile page or contacting us.

8. GDPR (EU/UK Users)

9. India — Digital Personal Data Protection Act 2023 (DPDP Act)

KidSpark complies with the Digital Personal Data Protection Act, 2023 (India). As a Data Fiduciary, we collect and process personal data only for the purposes described in this policy, with your free, specific, informed, and unambiguous consent obtained at the time of account creation.

• Significant Data Fiduciary — Children's Data: KidSpark processes data of children (through parent/guardian accounts) and takes additional precautions. We do not process children's personal data for tracking, behavioural monitoring, or targeted advertising.
• Right to Access: You may request a summary of personal data we hold about you by contacting our Grievance Officer.
• Right to Correction & Erasure: You may correct inaccurate data or request deletion of your account and all associated data at any time via the Profile page or by contacting us.
• Right to Withdraw Consent: You may withdraw consent at any time. Withdrawal does not affect processing already done. Account deactivation is available from the Profile page.
• Data Breach Notification: In the event of a personal data breach, we will notify affected users and the Data Protection Board of India as required by the DPDP Act.
• Data Localisation: Our primary data processor (Firebase/Google) may store data on servers outside India. By creating an account, you consent to cross-border transfer of your data to Google's servers in accordance with applicable law.

10. Grievance Redressal (IT Rules 2021 & Consumer Protection Act 2019)

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, KidSpark has appointed a Grievance Officer:

11. Recurring Payments — RBI Guidelines

KidSpark subscription payments are processed by Razorpay in compliance with Reserve Bank of India (RBI) guidelines on recurring transactions. You will receive a pre-debit notification before each renewal. You may cancel your subscription at any time from the Profile page, which will stop all future auto-debits. 12. Security

We use industry-standard security measures including Firebase's encrypted authentication, Firestore security rules, and HMAC-verified payment processing to protect your data. However, no method of transmission over the internet is 100% secure.

13. Changes to This Policy

We may update this policy from time to time. We will notify users of significant changes by updating the "Last updated" date above. Continued use of KidSpark after changes constitutes acceptance of the updated policy.

1. Overview

KidSpark offers subscription-based access to premium educational games for children. We want you to be completely satisfied with your purchase. This Refund Policy outlines the conditions under which refunds are granted.

2. Plans

• Starter Pack — ₹99 (one-time): A single, non-recurring charge that grants 30 days of full premium access. No subscription is created — you will never be auto-charged again after this payment.
• Monthly Plan — ₹199/month: Recurring subscription billed every month. Cancel anytime before the next billing date.
• Yearly Plan — ₹1,499/year: Recurring subscription billed once annually. Eligible for a full refund within 7 days, subject to usage conditions below.

3. Refund Eligibility

• Starter Pack (₹99): Non-refundable. As a one-time, low-cost access pass with no recurring commitment, the Starter Pack is not eligible for a refund once purchased. We only consider refund requests in the case of a verified duplicate or accidental charge.
• Yearly Plan: You may request a full refund within 7 days of your initial purchase date, provided you have played fewer than 5 premium game sessions during that period. Refunds will not be granted if 5 or more premium game sessions have been played, regardless of the time elapsed.
• Monthly Plan: Monthly subscriptions are non-refundable once the billing period has started. We only consider refund requests in the case of a verified duplicate or accidental charge.

4. Non-Refundable Situations

• Starter Pack purchases are non-refundable under all normal circumstances.
• Yearly plan refunds will not be granted after 7 days from the purchase date.
• Yearly plan refunds will not be granted if 5 or more premium game sessions have been played.
• Monthly plans are non-refundable under all normal circumstances.
• Partial refunds for unused days on any plan are not provided.
• Refunds are not available if your account has been suspended due to violation of our Terms of Service.

5. How to Request a Refund

We will respond within 2 business days. Approved refunds are processed within 5–7 business days and credited back to your original payment method.

6. Cancellation

Monthly and Yearly subscribers may cancel at any time from the Profile page. Cancellation stops future billing but does not automatically trigger a refund. Access to premium content continues until the end of the current billing period.

The Starter Pack is a one-time purchase and does not require cancellation — there is no recurring charge to stop.

7. Technical Issues

If you experience technical issues that prevent you from accessing premium content and we are unable to resolve them within 5 business days, you are entitled to a full refund regardless of the above conditions.

1. Payment Provider

All payments on KidSpark are securely processed by Razorpay, a PCI-DSS compliant payment gateway. KidSpark does not store any card numbers, bank account details, or sensitive payment information on its servers.

2. Accepted Payment Methods

3. Plans & Billing

• Starter Pack (₹99 — one-time): A single, non-recurring charge. You are charged once and never again. Grants 30 days of full premium access with no subscription created.
• Monthly Plan (₹199/month): Your card or UPI is automatically charged every 30 days from your subscription start date.
• Yearly Plan (₹1,499/year): A single charge of ₹1,499 is made on your subscription start date and again on the same date each year.
• You will receive an email receipt from Razorpay after every successful payment.

4. Auto-Renewal

Monthly and Yearly subscriptions renew automatically at the end of each billing period. You will not be separately notified before each renewal. To avoid being charged for the next period, cancel your subscription at least 24 hours before the renewal date from your Profile page.

The Starter Pack is a one-time payment and does not auto-renew.

5. Failed Payments

If a payment fails (insufficient funds, expired card, etc.), Razorpay will attempt to retry the charge. If payment cannot be collected after retry attempts, your premium access will be paused until a successful payment is made. You will be notified by email to update your payment method.

6. Pricing & Taxes

• All prices displayed are in Indian Rupees (₹) and are inclusive of applicable taxes (GST).
• KidSpark reserves the right to change subscription pricing with 30 days' advance notice to existing subscribers.
• Price changes do not affect your current billing period — the new price applies from the next renewal.

7. Security

8. Disputes

2. Eligibility — Parent & Guardian Accounts

All accounts must be created by a parent or guardian aged 18 or older. By creating an account, you confirm that you are of legal age and are creating the account on behalf of your child. We do not knowingly allow children under 13 to register directly. If we discover an underage account created without parental consent, we will delete it promptly.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating your account.

• You may not share, sell, or transfer your account to another person.

4. Free & Premium Access

KidSpark offers both free and premium content:

• Free tier: Selected games are available without a subscription. No payment details are required.
• Premium tier: Full access to all games, the curriculum practice path (LKG to Grade 5 / Year 1–5 — Maths, English and Science), downloadable worksheets, and achievement certificates requires one of the following:
  • Starter Pack — ₹99 (one-time, 30 days, no auto-renewal)
  • Monthly Plan — ₹199/month (recurring)
  • Yearly Plan — ₹1,499/year (recurring)
• Premium features are accessible only while your access is active. Once a Starter Pack expires or a subscription lapses or is cancelled, access to premium content will end at the close of the current period.

5. Subscriptions & Billing

• Subscriptions are billed on a recurring basis (monthly or annually) through Razorpay.
• Your subscription renews automatically unless cancelled at least 24 hours before the renewal date.
• You can cancel your subscription at any time from the Profile page. Cancellation takes effect at the end of the current billing period.
• All pricing is in Indian Rupees (₹) and inclusive of applicable taxes.
• We reserve the right to change subscription pricing with at least 30 days' advance notice.

6. Refunds

Refunds are governed by our Refund Policy. In summary: the Starter Pack (₹99) is non-refundable. Yearly plans are eligible for a full refund within 7 days of purchase provided fewer than 5 premium game sessions have been played. Monthly plans are non-refundable once the billing period has started.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, copy, or reproduce any part of the Service or its content.
• Use automated tools, bots, or scrapers to access or extract content from the Service.
• Impersonate another person or misrepresent your identity.
• Upload or transmit any harmful, offensive, or malicious content.

8. Intellectual Property

All content on KidSpark — including game designs, questions, artwork, text, and software — is owned by KidSpark and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission. Downloadable worksheets and certificates are licensed for personal, non-commercial use only.

9. User Content & Leaderboard

Your chosen display name may appear publicly on the KidSpark leaderboard. By using the Service, you grant us a non-exclusive licence to display your display name and game scores on the leaderboard. You are responsible for ensuring your display name is appropriate and does not violate any third-party rights.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We make no representations about the accuracy or completeness of any content on the Service.

11. Limitation of Liability

To the fullest extent permitted by law, KidSpark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to access the Service will immediately cease. Provisions relating to intellectual property, disclaimer of warranties, and limitation of liability survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
